The SCHLUTER SYSTEMS logo, is a trademark of SCHLUTER SYSTEMS or its related companies, which is registered in the United States and other countries. Other SCHLUTER SYSTEMS product or service names or logos referenced in the Site are trademarks or registered trademarks of SCHLUTER SYSTEMS or its related companies. All other products, services and company names mentioned in the Site may be trademarks of their respective owners. You may not use any trademark displayed on the Site without the written permission of SCHLUTER SYSTEMS or the relevant owner of the trademark.
Permission to use SCHLUTER SYSTEMS trademark/logo on the internet/world wide web, will be evaluated as follows:
SCHLUTER SYSTEMS L.P. and SCHLUTER SYSTEMS (CANADA) INC. recognizes three types of web sites that will be governed by this authorization. They are: Forums, Educational, and businesses.
a) Forums.
Site(s) that are created by a person(s), that are not-for-profit, can use the name SCHLUTER SYSTEMS logo(s) and trademark(s) on web pages.
Prior approval from Schluter Systems L.P. is required.
b) Educational.
Site(s) that are managed by a non-for-profit individual can use the name SCHLUTER. These are educational sites whose sole purpose is to educate on-line users on proper installation methods. This is not a club site or a business site. This type of site may use the SCHLUTER logo(s) and trademark(s) on web pages.
Prior approval from Schluter Systems L.P. is required.
c) Businesses.
Site(s) that are selling SCHLUTER products and/or services for a profit shall not be allowed to use the SCHLUTER SYSTEMS logo(s) or trademark(s) in any infringing manner on the internet, which is the same legal restriction as applied to any other communications media. The use of the name is also strictly forbidden in the domain name. Use of trademark(s) and logo(s) on web pages is also forbidden. Permission to use SCHLUTER SYSTEMS' logo(s) or trademark(s) for a profit is solely granted to Authorized SCHLUTER Distributors and Dealers that have a signed agreement with SCHLUTER SYSTEMS.

6. Privacy and Confidential Information.
SCHLUTER SYSTEMS’ Privacy and Security Policy, is a binding part of these Terms and Conditions.
7. Indemnity.
You agree to defend, indemnify and hold SCHLUTER SYSTEMS and its related companies harmless from any and all liabilities, costs and expenses, including reasonable attorneys' fees, related to any violation of these Terms and Conditions by you or users of your account, or in connection with the use of this Site or the placement or transmission of any information or other materials on this Site by you or users of your account.
8. Territory.
The SCHLUTER SYSTEMS site originates in Germany. SCHLUTER SYSTEMS' products and services are offered in SCHLUTER SYSTEMS's operating territory. Some products and services referred to on the Site may not be available in all parts of SCHLUTER SYSTEMS's territory. Consult your SCHLUTER SYSTEMS business office, listed in your local telephone directory, for information regarding the products and services which may be available to you in your area.
9. Changes.
SCHLUTER SYSTEMS reserves the right to change or remove any Content from the Site, in whole or in part, at its sole discretion, at any time, without notice.
10. Miscellaneous.
These Terms and Conditions, including the SCHLUTER SYSTEMS Privacy and Security Policy, is a binding part of these Terms and Conditions. and other documents referenced herein, constitute the entire agreement between SCHLUTER SYSTEMS and you with respect to your use of this Site. SCHLUTER SYSTEMS's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. If any of the Terms and Conditions is determined to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions hereof. This Agreement shall be governed by and construed in accordance with the laws in the state of New York.
